Collecting What Is Owed, to the End — Successive Victories and Enforcement in Multiple Debt Claims for a Corporate Client

Background

When a counterparty withholds payment or fails to repay a loan, obtaining a judgment and actually recovering the money are two entirely different things. Acting for a corporate client, Changchun handled numerous debt claims against a range of counterparties and obtained one favorable judgment after another.

The Issue — Beyond Judgment, to "Recovery"

The key was ① to prove clearly how each claim arose in each transaction and secure a favorable judgment, and ② to deploy enforcement and pressure measures at the right moment so that the judgment translated into actual payment.

How Changchun Helped

Changchun (attorneys Jaesun Yoon, Donghwan Shin and Sieun Kim) ① secured favorable judgments in each case by organizing the contracts, transaction records and the fact of non-payment, and ② where debtors still failed to pay after judgment, pursued applications to enter them in the register of defaulters — a powerful pressure measure that directly affects a debtor's credit — along with compulsory execution proceedings, so that the judgments did not remain mere paper.

Changchun won one debt case after another for our client and, rather than stopping at judgment, carried the matters through to enforcement in pursuit of substantive recovery. The case shows that securing both "winning" and "getting paid" is the essence of a debt dispute. (Outcomes may differ depending on the facts of each matter.)
