A Traffic Accident Written Off as "Two Weeks' Recovery" — Proving Residual Disability and Recovering Over KRW 100 Million

Background

Our client injured an elbow in a hit-and-run and was initially given a "two weeks' recovery" diagnosis. Over time, however, they suffered lasting effects — nerve damage and weakened muscle strength. The insurer nonetheless took a passive approach, offering only a very small settlement.

What Was at Stake

Judged by the initial "two weeks' recovery" diagnosis alone, it looked like a minor accident. The key was how to prove objectively the nerve damage, loss of earning capacity and psychological after-effects that were not outwardly apparent.

How Changchun Helped

Acting for our client, Changchun brought a damages claim and pursued medical appraisal proceedings actively to prove residual disability, including loss of earning capacity from nerve damage and persistent pain.

The court recognized KRW 110 million in loss, on top of the medical expenses incurred to that point. What might have ended in a small settlement instead yielded proper compensation, because the residual disability was properly proven. (Outcomes depend on the facts of each case and may differ.)
