Background
Our client was a young man working part-time jobs. Despite two prior criminal penalties for drunk driving, he was caught driving under the influence again, with a high blood alcohol level.
In April 2025 the first-instance court sentenced him to one year in prison. He appealed, arguing the sentence was too heavy.
What Was at Stake
Drunk driving endangers the lives and safety of others, and repeat offenders are usually punished severely. The question on appeal was whether there were grounds to give him another chance despite the aggravating factors.
How Changchun Helped
Law Firm Changchun represented our client on appeal, and the appellate court accepted these mitigating factors:
Remorse: He admitted his wrongdoing and committed to never driving under the influence again.
Nature of the offense: He drove a relatively short distance and caused no injury or property damage.
Prior record: There was a time gap since his last drunk driving conviction, and he had no criminal record other than the two drunk driving penalties.
Outcome
In June 2025 the appellate court vacated the first-instance judgment and imposed one year in prison, suspended for three years. It also ordered 120 hours of community service and 40 hours of a law-abiding driving course. Our client avoided prison and can continue his efforts to prevent reoffending while living in the community.
Even where a prison sentence has been imposed on a repeat drunk driver, presenting specific mitigating circumstances on appeal can open the door to a suspended sentence. (Outcomes depend on the facts of each case.)
