Law Firm Changchun represented the defendant and obtained judgment in full in a forced heirship (statutory reserve) claim brought on the basis that the parents had, during their lifetime, provided business funds to one child alone and had put up their own real estate as security so that child could borrow business funds.
In that action Changchun argued forcefully that bank transfer records alone cannot establish a lifetime gift, and that where the deceased created a mortgage over their own property during their lifetime to secure the company's debts, and that debt was then discharged through a voluntary auction or otherwise, it does not follow that the defendant personally received a lifetime gift. The court accepted all of the defendant's arguments and dismissed the plaintiffs' forced heirship claims in their entirety.
