Acting for NBT, Winning a "Mobile Lock Screen" Patent Suit Against Buzzvil

Law Firm Changchun represented NBT Inc., the operator of Cashslide and the petitioner in the invalidation proceedings, in a suit to revoke the invalidation decision concerning Buzzvil's patent for an "advertising system and method using an advertising module included in an application" (Patent No. 1315468), and obtained a final judgment in NBT's favor (Supreme Court, May 28, 2020, 2020Hu10209).

In January 2018, NBT petitioned for invalidation of Buzzvil's patent relating to a lock screen advertising module. The Intellectual Property Trial and Appeal Board held that "the petitioner's argument that Buzzvil's patented technology could readily have been invented from the prior art of Cashslide and adware, and should therefore be invalidated, is well founded," and issued a decision of invalidity.

Buzzvil appealed twice, but both the Patent Court and the Supreme Court accepted NBT's arguments, finally ruling that the patent be invalidated with effect from the 28th of last month.

Buzzvil made a correction during the proceedings narrowing the scope of the patent, but Law Firm Changchun analyzed the scope of the corrected claims in detail and successfully proved that even with that correction Buzzvil's patent could not be regarded as involving an inventive step. The Patent Court and the Supreme Court accordingly held that the patent could readily have been invented from NBT's Cashslide service and other adware existing before Buzzvil's patent application, and that invalidation was therefore appropriate (judgment against the plaintiff).
