A Case Referred as a Domestic Protection Matter

Law Firm Changchun represented a person accused of domestic violence in a case referred as a domestic protection matter following an assault on a child, and obtained a decision of no disposition on the ground that a protective disposition could not, or need not, be imposed.

A domestic protection case is one subject to a protective disposition under the Act on Special Cases Concerning the Punishment of Crimes of Domestic Violence and heard in the family court. Where the court finds on the hearing that a protective disposition is warranted, it may impose measures of various kinds, including restrictions on approach, restrictions on communication, restrictions on the exercise of parental authority, community service or attendance orders, probation, entrustment to custody and entrustment for treatment.

In this case Law Firm Changchun's dedicated family law team, drawing on extensive experience and expertise, explained in concrete terms how the violence came about and how minor it was, putting before the court a detailed argument that no protective disposition was necessary — and so achieved the successful outcome of a "decision of no disposition," the equivalent of an acquittal.
