Law Firm Changchun represented a participating company in a suit seeking a declaration that sanctions imposed by the Korea Technology and Information Promotion Agency for SMEs on supplier and adopter companies in a smart factory program were void, and obtained judgment in its favor.
The plaintiff had been selected as a supplier company in the smart factory dissemination and expansion program and entered into a support agreement covering the new implementation of a manufacturing execution system (MES). A disagreement arose with the adopting company over the scope of the project, as it sought services outside the original scope; the plaintiff paid part of a settlement sum to resolve the dispute, then realized this could be problematic and cancelled it. The defendant's Smart Manufacturing Innovation Promotion Team at the Korea Technology and Information Promotion Agency for SMEs then imposed sanctions on the plaintiff, including a bar on participation, and the plaintiff brought suit seeking a declaration that those sanctions were void.
In that suit, Law Firm Changchun argued that no provision existed authorizing the defendant's sanctions and that the sanctions against the plaintiff violated the principle of proportionality, and the court entered judgment for the plaintiff, declaring the defendant's sanctions void.
